1. About These Terms

These Terms govern the use of arasweld.com and purchases of ARASWELD products. By placing an order or accepting a quotation or written agreement, you accept the terms applicable to that transaction. Please contact us before ordering if anything is unclear.

2. B2C and B2B Customers

A B2C customer is an individual purchasing mainly for personal use. A B2B customer is a business, reseller, contractor, industrial organization or professional purchasing for commercial or occupational purposes.

B2B orders may have separate quantities, specifications, prices, payment terms and delivery conditions. Mandatory B2C consumer rights remain unaffected.

3. Product Information

We aim to describe products accurately. Minor variations may result from manufacturing, natural materials, displays or product improvements.

Certification and protection ratings apply only to the product model identified in the relevant documentation. Order-specific requirements must be confirmed in writing.

4. Orders and Contract Acceptance

Submitting a website order, Request for Quotation (RFQ), inquiry or purchase order is an offer to purchase and does not automatically constitute acceptance.

For B2C orders, an automated email may only confirm receipt. A contract is formed when ARASWELD accepts the order through an order-confirmation or dispatch notice.

For B2B orders, a contract is formed when the parties accept a quotation, proforma invoice, purchase-order confirmation, approved specification or signed agreement in writing.

We may reject or cancel an order for reasonable grounds, including unavailability, pricing or technical errors, failed payment, suspected fraud, legal restrictions or inability to meet the requested specification. Payments received for cancelled orders will be handled under applicable law and agreed terms.

5. Prices, Payments and Taxes

Website prices generally apply to standard retail purchases unless stated otherwise. Wholesale, bulk, private-label and custom prices are provided separately. Payment methods, deposits, currencies and due dates may vary by order.

Shipping, taxes, customs duties, bank fees and other costs will be shown at checkout or stated in the quotation or proforma invoice. Production or dispatch may depend on receipt of the agreed payment.

6. Cancellations

B2C customers may request cancellation before dispatch, subject to order status and applicable law.

B2B cancellations require written approval and may be subject to costs already incurred. Bulk, private-label and custom orders may become non-cancellable after materials are purchased, approvals are given or production begins.

This does not remove rights concerning verified defects, incorrect goods or failure to meet agreed specifications.

7. B2C Returns and Refunds

Eligible B2C customers may notify us of a return within 14 days of delivery, subject to applicable law and statutory exceptions. Products must not show industrial use, contamination or customer-caused damage.

Approved refunds will normally be made through the original payment method. Return procedures, deadlines, shipping responsibilities and exceptions are explained in our Refund and Returns Policy.

Nothing in these Terms limits rights that cannot legally be excluded.

8. B2B Returns and Claims

B2B returns require prior written authorization. Claims concerning defects, incorrect products, transit damage or non-conformity must be reported within the period stated in the applicable documents.

We may request photographs, batch information or samples. An approved claim may result in repair, replacement, account credit or refund, depending on the circumstances.

9. Bulk, Wholesale and Custom Orders

Bulk and custom orders may be subject to minimum quantities, sample approval, technical specifications, branding requirements and production lead times. Quotation validity will be stated in the quotation.

The buyer must approve specifications, samples, artwork and order details before production. Custom or private-label products are not eligible for ordinary change-of-mind returns unless agreed otherwise.

Rights relating to verified defects or non-conformity remain unaffected.

10. Shipping and Delivery

Shipping methods, estimated lead times, delivery terms and customs responsibilities vary by destination and order type.

International B2B orders may use an agreed Incoterm and named destination stated in the accepted quotation or proforma invoice.

Delivery dates are estimates unless expressly guaranteed in writing. Further information appears in our Shipping & Global Delivery Policy.

11. Product Selection and Use

Customers are responsible for selecting products suitable for the intended welding process, workplace hazards and applicable safety requirements.

Products must be inspected before use and used according to their documentation, warnings and workplace procedures.

12. Limitation of Liability

To the extent permitted by law, ARASWELD is not responsible for loss caused by misuse, use beyond documented limitations, unauthorized alteration, normal wear, failure to follow instructions or customer-supplied specifications.

Nothing in these Terms excludes liability for fraud, intentional misconduct, verified product defects or any liability or right that cannot lawfully be excluded.

Order-specific liability provisions may be included in a B2B agreement.

13. Force Majeure

We are not responsible for delays caused by events beyond our reasonable control, including disasters, war, government restrictions, customs action, carrier disruption, strikes, shortages or major system failures.

We will communicate material delays when possible.

14. Relationship Between Documents

These Terms provide the general framework. Where documents expressly differ, the following order normally applies:

  1. Signed supply agreement
  2. Accepted quotation or proforma invoice
  3. Approved technical specifications
  4. Written purchase-order confirmation
  5. These Terms & Conditions
  6. Other website policies

Mandatory B2C rights take priority where required by law.

15. Privacy and Changes

Personal data is handled according to our Privacy Policy.

We may update these Terms, but the version applying to an order is generally the version in effect when that order is accepted, unless otherwise agreed in writing.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, unless mandatory law requires otherwise.

B2B disputes are subject to the forum stated in the applicable agreement or, if none is stated, the competent courts and enforcement offices of Istanbul.

B2C customers retain mandatory consumer protections and dispute-resolution rights available under applicable law.
